Terms of Use

These Terms of Use ("Terms") govern your access to and use of the LinkBiz platform ("Platform", "we", "us") available at linkbiz.in. By creating an account or using our Platform, you agree to these Terms in full.

If you do not agree to these Terms, please do not use the Platform.

1. Eligibility

• You must be at least 18 years of age to use this Platform.
• By registering, you confirm you are legally capable of entering into binding contracts under Indian law.
• Businesses must be legitimately operating in India to create listings.

2. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You must not share your account with others or allow unauthorised access.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at linkbiz21726@gmail.com if you suspect unauthorised access.
• One person/business may maintain only one account unless explicitly permitted.

3. Listing Rules

When creating a business, property, provider, or builder listing:

• All information must be accurate, truthful, and up to date.
• You must own or have authorisation to list the business/property.
• Fake, duplicate, or misleading listings will be permanently removed.
• Adult content, illegal services, gambling, or weapons-related listings are strictly prohibited.
• Photos uploaded must be your own — no copyright-infringing images.
• RERA registration number (if provided) must be valid and verifiable.

4. Reviews and Ratings

• Reviews must be based on genuine personal experience.
• Fake reviews — whether positive (for your own listing) or negative (for competitors) — are strictly prohibited.
• We reserve the right to remove any review that is abusive, defamatory, false, or irrelevant.
• Business owners may reply to reviews but must not threaten or harass reviewers.
• Incentivised reviews (paying or offering discounts for reviews) are not permitted.

5. Bookings

• Bookings made on the Platform are subject to confirmation by the service provider/business owner.
• LinkBiz is a booking facilitation platform — we are not a party to the service transaction.
• Disputes regarding service quality must be resolved between the customer and business owner directly.
• Cancellation policies are set by each business owner and shown at the time of booking.
• LinkBiz is not liable for any loss, damage, or dissatisfaction arising from booked services.

6. Payments, Plans and Credits

• All payments are processed securely through Razorpay. LinkBiz does not store card details.
• Subscription plans are billed as per the plan cycle (monthly/annual). Prices are inclusive of applicable GST.
• Credits purchased are non-refundable and non-transferable.
• Subscription cancellation stops future renewals but does not entitle you to a pro-rated refund for the current period.
• In case of a payment failure, contact us within 7 days at linkbiz21726@gmail.com.

7. Lead Reveal and Credits

• When a customer submits an inquiry (lead), their contact details are masked by default.
• Business owners must use credits to reveal a lead's full contact information.
• Credits once used to reveal a lead cannot be refunded.
• Misuse of revealed lead data (spam, harassment, unsolicited marketing) will result in immediate account suspension.

8. Prohibited Activities

The following are strictly prohibited on LinkBiz:

• Uploading false, fraudulent, or misleading content
• Impersonating another person, business, or organisation
• Using the Platform to send spam, phishing messages, or unsolicited communications
• Attempting to hack, scrape, or reverse-engineer the Platform
• Using bots or automated tools to create listings, reviews, or leads
• Listing services that are illegal under Indian law
• Harassing, threatening, or abusing other users via in-app chat or reviews
• Circumventing the credit/lead reveal system through any technical means

9. Intellectual Property

• The LinkBiz name, logo, design, and platform code are the intellectual property of LinkBiz.
• You may not copy, reproduce, redistribute, or resell any part of the Platform without written permission.
• By uploading photos or content to the Platform, you grant LinkBiz a non-exclusive licence to display and use that content to provide the service.
• You retain ownership of your uploaded content.
• You are solely responsible for any content (including photos) you upload, and you must have the legal right to use it — uploading an image copied from a search engine, another website, or any source you don't own or have a licence for is a violation of these Terms and may infringe the original creator's copyright.

9.1 Reporting a Copyright Complaint

If you believe content on LinkBiz infringes your copyright, please contact us with: (a) a description of the copyrighted work, (b) the URL of the listing/product using it, (c) your contact details, and (d) a statement that you own the rights or are authorised to act on the owner's behalf. We will review valid complaints and remove infringing content within a reasonable time. Repeat offenders among sellers/listers may have their account suspended.

10. Account Suspension and Termination

We reserve the right to suspend or permanently delete your account if:

• You violate these Terms or our Privacy Policy
• Your listing is found to be fake, illegal, or misleading
• You engage in abusive behaviour towards other users
• Your account is associated with fraudulent payment activity

Upon termination, your listings will be removed and credits forfeited. We will provide notice except in cases of severe or repeated violations.

11. Limitation of Liability

• LinkBiz is a listing and discovery platform. We do not verify the quality of services provided by listed businesses.
• We are not liable for any loss, damage, injury, or dissatisfaction arising from services booked through the Platform.
• Our maximum liability to you under any circumstances shall not exceed the amount paid by you to LinkBiz in the 3 months prior to the claim.
• We are not responsible for outages, data loss due to hardware failure, or third-party service failures (Razorpay, SMS gateway, etc.)

12. Governing Law and Disputes

• These Terms are governed by the laws of India.
• Any disputes arising from these Terms shall first be attempted to be resolved amicably within 30 days.
• If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in India.
• For consumer complaints, you may also approach the relevant Consumer Disputes Redressal Forum.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 7 days in advance. Continued use of the Platform after the effective date constitutes acceptance.
